1. Introduction and Key Information

Welcome to SimsBuddy (www.simsbuddy.com). These Terms and Conditions ("Terms") govern your use of our website and services.

IMPORTANT: Please read these Terms carefully before using our Service. By creating an account or making a purchase, you agree to these Terms. If you do not agree, please do not use our Service.

2. Your Consumer Rights

IMPORTANT NOTICE ABOUT YOUR LEGAL RIGHTS

As a consumer purchasing from a UK business, you have statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. Nothing in these Terms affects your statutory rights.

Your statutory rights include:

  • (a) The right to receive digital content that is of satisfactory quality, fit for purpose, and as described;
  • (b) The right to a remedy (repair, replacement, or refund) if digital content is faulty or not as described;
  • (c) The 14-day cancellation right for distance contracts (subject to exceptions for digital content - see Section 5).

3. Description of Service

SimsBuddy provides an online medical education platform that offers:

  • (a) Access to courses for various medical examinations
  • (b) AI-powered virtual patient simulations for exam preparation
  • (c) Interactive practice scenarios and clinical case studies
  • (d) Educational materials and revision resources

MEDICAL DISCLAIMER: All content is for EDUCATIONAL PURPOSES ONLY. It is NOT intended to provide medical advice, diagnosis, or treatment. Virtual patient simulations are fictional scenarios for exam preparation and must NOT be used for actual clinical decision-making. Always consult qualified healthcare providers for medical conditions.

4. Eligibility and Account Registration

Age Requirement

You must be at least 18 years old to use our Service.

Intended Users

Medical students, healthcare trainees, healthcare professionals, medical educators, and academic institutions.

Account Security

You agree to:

  • (a) provide accurate information;
  • (b) maintain the security of your login credentials;
  • (c) accept responsibility for all activities under your account;
  • (d) notify us immediately of any unauthorised use.

Accounts are personal and must not be shared.

5. Subscription and Payment Terms

5.1 How Our Subscriptions Work

We offer two types of purchases:

(A) Course Access Subscriptions: Time-limited access to specific courses (e.g., 3 months access). These are NOT automatically renewing - you must manually purchase a new subscription when your access expires.

(B) AI Practice Credits: Prepaid credits for AI virtual patient practice sessions. 1 Credit = 1 minute of practice time. Credits NEVER expire once purchased.

5.2 Your Right to Cancel (Digital Content)

IMPORTANT - PLEASE READ CAREFULLY:

Under the Consumer Contracts Regulations 2013, you normally have 14 days to cancel a distance contract. However, for digital content, this right is lost once the content has been accessed/downloaded if you have given your express consent and acknowledged this loss.

BY COMPLETING YOUR PURCHASE AND TICKING THE CHECKBOX CONFIRMING YOU WISH TO ACCESS CONTENT IMMEDIATELY, YOU:

  • (a) Expressly request that we begin providing the digital content immediately;
  • (b) Acknowledge that you will lose your 14-day cancellation right once you access the digital content;
  • (c) Confirm you understand this before purchase.

If you do NOT tick this checkbox, you will need to wait 14 days before accessing content, during which time you can cancel for a full refund.

5.3 Cancellation Policy (After Cooling-Off Period)

Course Access Subscriptions: Once the 14-day cancellation period has passed (or been waived), course access subscriptions cannot be cancelled mid-term for a refund. You retain access until your subscription period expires.

AI Credits: AI Credits are non-refundable under normal circumstances as they never expire and can be used at any time.

5.4 Refund Policy

Refunds for Faulty Digital Content: Under the Consumer Rights Act 2015, you are entitled to a refund if digital content is:

  • (a) not of satisfactory quality;
  • (b) not fit for a particular purpose; or
  • (c) not as described.

If our digital content is faulty, please contact us and we will provide a full or partial refund as appropriate.

Refunds for Technical Issues: We will provide refunds where technical issues on our platform have materially affected your ability to use the Service you paid for. This includes:

  • Persistent platform outages preventing access to purchased courses for more than 48 consecutive hours
  • AI system failures preventing use of purchased AI Credits
  • Documented technical errors affecting course functionality

How to Request a Refund: Contact us within 30 days of the issue, providing:

  • (a) description of the issue;
  • (b) evidence where possible (screenshots, error messages);
  • (c) dates affected.

We will investigate and respond within 14 days.

5.5 Pricing and Payment

All prices are displayed in GBP and include VAT where applicable. Prices are clearly displayed before you confirm your purchase. Payment is processed securely by Stripe. By providing payment details, you confirm you are authorised to use that payment method.

6. Acceptable Use Policy

Permitted Uses

  • Personal educational and training purposes;
  • Exam preparation;
  • Developing clinical skills;
  • Academic research with attribution.

Prohibited Uses

You must NOT:

  • (a) use content for actual patient care;
  • (b) share login credentials;
  • (c) copy, reproduce or distribute content;
  • (d) reverse engineer our AI systems;
  • (e) use the Service illegally;
  • (f) interfere with platform security;
  • (g) use offensive or discriminatory language.

Violation of these terms may result in immediate account termination without refund.

7. Intellectual Property Rights

All content, courses, AI systems, and materials on the Service are owned by SimsBuddy or our licensors and protected by copyright and intellectual property laws. You receive a limited, personal, non-transferable licence to access content for your own educational purposes. You may not copy, distribute, or create derivative works without written permission.

8. Disclaimers and Limitations

8.1 Educational Purpose

Our Service is for education only. We cannot guarantee exam success. Virtual patient scenarios are fictional. Drug dosages must be verified with authoritative sources (e.g., BNF) before prescribing.

8.2 Limitation of Liability

To the extent permitted by law, our total liability for any claim shall not exceed the amount you paid us in the 12 months before the claim arose.

We do NOT exclude or limit liability for:

  • (a) death or personal injury caused by our negligence;
  • (b) fraud or fraudulent misrepresentation;
  • (c) breach of your statutory rights under the Consumer Rights Act 2015;
  • (d) any other liability that cannot be excluded by law.

8.3 Service Availability

We strive for continuous availability but cannot guarantee uninterrupted access. We may suspend access for maintenance with reasonable notice where possible.

9. Termination

Termination by You

You may stop using the Service at any time. Contact us to close your account.

Termination by Us

We may suspend or terminate your access immediately if you:

  • (a) breach these Terms;
  • (b) engage in prohibited activities;
  • (c) fail to pay;
  • (d) use the Service fraudulently.

Effect

Upon termination, your access ceases. Outstanding payments remain due. Your statutory rights are unaffected.

10. Complaints Procedure

If you have a complaint about our Service:

  • 1. Contact us by email at simsbuddyteam@gmail.com with details of your complaint.
  • 2. We will acknowledge your complaint within 3 business days.
  • 3. We will investigate and provide a full response within 14 days.
  • 4. If you are not satisfied with our response, you may seek independent advice from Citizens Advice or pursue legal remedies.

11. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy and Cookie Policy, available on our website. By using our Service, you consent to processing as described in those policies.

12. Changes to These Terms

We may update these Terms. Material changes will be notified by email and website notice at least 14 days before taking effect. Continued use after changes indicates acceptance. If you disagree, you should stop using the Service.

13. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. This does not affect your statutory rights to bring claims in your local courts if you are a consumer.

14. General Provisions

Severability

If any provision is found invalid, the remaining provisions remain in effect.

Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Legal Disclaimer, constitute the entire agreement between you and SimsBuddy.

Your Statutory Rights

Nothing in these Terms affects your statutory rights as a consumer under UK law.
